TERMS OF SALE
By entering your details to make a purchase, you are agreeing to make a contract to purchase goods from WINE BY SAM PTY LTD, ABN. 25 892 938 057. Referred to as ‘Wine by Sam’ herein.
Sale of the goods is based on the terms and conditions as detailed in these Terms and Conditions.
The contract is made at our licensed retail premises, 69-71 Anzac Ave Seymour, Victoria, 3660, from where the goods will be despatched under our Liquor Licence No. 32600597.
Under the Liquor Control Reform Act 1998 it is an offence to supply alcohol to a person under the age of 18 years. By entering and confirming payment, you are certifying that you are 18 years of age or older.
No material from this site can be produced without the express permission of Wine by Sam management.
Orders cannot be cancelled once accepted, unless arrangements are confirmed by Wine by Sam management.

Wine by Sam will endeavour to deliver goods within an indicated period, however it does not guarantee delivery on a prescribed date and is not liable for any Loss resulting from late delivery.
Some postcodes may be excluded from receiving deliveries, contact management to arrange for an alternative delivery address. Wine by Sam does not deliver to a Post Office Box.
Delivery can be accepted and signed by anyone at the delivery address who are presumed to be authorised to receive the goods. Proof of identification and evidence of proof of age may be requested to verify identity and proof of age that the person is aged 18 years or over. The goods will not be delivered to a person under the age of 18 years.
Any person at the nominated delivery address who receives the goods will be presumed to be an authorised person to receive the goods.
If a delivery is received with one or more broken bottles, Wine by Sam will issue a refund or provide replacement bottles if they are available. Customers are to contact management within 14 days to request a refund or replacement.
PRODUCT AVAILABILITY
Products offered for sale are subject to available stock. If a product is out of stock Wine by Sam may offer the customer an alternative product. If the alternative product is not accepted and payment has been completed, Wine by Sam will offer a refund or a credit for the amount charged.
PRICE & PAYMENT
Prices are subject to variation. The price payable for the goods is the price applicable on the date when an order is confirmed.
The listed price includes GST but does not include postage and handling. The total amount payable is the price for each of the goods together with the applicable delivery and handling fee.

Full payment for an order is to be received before products are despatched for delivery. At confirmation of an order payment will be deducted from the customer’s credit card. Wine by Sam accepts payment by Visa, Mastercard and Diners Club. American Express is not accepted.
Credit card details are processed using SSL encryption and are not stored by Wine by Sam.
NOTICES & MARKETING
By providing details upon purchase via our online store, customers subscribe to receive notifications regarding special offers, promotions and special events offered by Wine by Sam, until such time as requested by the customer to stop. Should a customer wish to opt out of receiving marketing notifications they are requested to contact Wine by Sam via phone or email. Upon receipt of such a request Wine by Sam will remove a customer’s details from their direct marketing data base as soon as reasonably practicable.
PRIVACY POLICY
Wine by Sam is committed to compliance with Australia’s Privacy Act 1988 and Australian Privacy Principles.
Collection of personal information will only be for what is considered reasonable for Wine by Sam to conduct their business operations. Primarily this will be for the purposes of completing sales transactions and their subsequent delivery, providing information regarding promotions and events and in general keeping customers informed about their business activities.
Wine by Sam is committed to protecting the privacy of individual’s personal details and information. Should an individual request their personal information details be destroyed and cease to be collected, Wine by Sam will comply with this request.
Wine by Sam will not disclose or on-sell personal details to a third party.
Personal detail information will be stored in a manner which protects and maintains the security of the data, including maintaining secure access, control of use, access and maintenance. Reasonable attempts will be made to ensure information supplied is correct and up to date.
Wine by Sam does not require the collection of an individual’s personal information to access their website or visit their business, unless such information is required to respond to a query, employment application or provide product.

By supplying Wine by Sam with information, the participant accepts the inherent security implications of conducting online communications and transaction and will agree not to hold Wine by Sam responsible for any breach of security.
LIMITATION OF LIABILITY
Nothing in this Contract is to be interpreted as having the effect of excluding, restricting or modifying any condition or warranty, or right or liability implied by any applicable legislation into the arrangement between Wine by Sam and the customer.
To breach of any condition or warranty implied into the arrangement between Wine by Sam and the customer, and which cannit be excluded or modified, Wine by Sam’s liability is limited to, at their discretion, either: (i) replacement of goods or supply of equivalent goods; (ii) payment of the cost of replacing the goods or providing credit for the cost of goods; and in the case of services, to: (i) supply the services again
Subject to the forgoing, Wine byu Sam is not liable to the customer, (or to any third party), for any loss, liability, damage, expense or cost shawtsoever and includes, (without limitation) indirect or consequential loss or damage, loss of profits or business opportunity, and damage to equipment or property caused by any act or omission of Wine by Sam, its employees or agents and whether based on negliegence orother tort or contract or otherwise.
AMENDMENTS
Wine by Sam may add, delete, or otherwise change any terms of this Contract. Wine by Sam will notify of any substantial changes to these terms and conditions. The use of Wine by Sam’s service after such notice will constitute acceptance of such changes.
